Legal Question in Criminal Law in California

can you face jail time if you were supposed to complete the pc1000 program, didnt finish you classes, have one failure to appear and a new charge of petty theft but was dismissed? I thought the judge was going to reinstate me or maybe eligible for prop 36 but instead he wants me to serve jail time. This is in LA county, pomona court. Thank you...Lisa

DUH. Of course. Your probation violation, and the added insult to the court of new charges against you, would likely result in revocation of probation, and imposition of the original jail sentence you avoided by agreeing to the 'program', plus any time on new charges. That is the consequence of disobeying the court orders and violating the terms of your probation.
