Felony

My boyfriend was caught buying stolen goods and they caught him. They are giving him 10 months and sending him upstate. This is his first offense can we get this kicked out of court or and enspongement to clear his record?

Sounds like the train has left the station as far as defending him in court if he already agreed to 10 months. If there is still time, get him a good lawyer.

By upstate I take it to mean state prison in which case he will not be eligible to expunge his conviction later. Only defendants who get probation with or without county jail time qualify. Sorry.
