Legal Question in Criminal Law in California

My girlfriend and I were going through a DUI check point. She was driving, but her license was suspended. Neither of us was under the influence of drugs or alcohol, yet my car was impounded. Even though I showed the officers my legitimate driver�s license, proof of insurance, and current vehicle registration, they would not release my car to me. I�m being told they will hold my car for 30 days, or until my girlfriend obtain a legal license. Is it legal for the police to withhold my car for 30 days, even though I personally did nothing wrong?

Unfortunately if you allow a person who does not have a valid driver's license drive your car it can be impounded for up to one month. Your girlfriend should immediately take the steps necessary to obtain her driver's license. You could also talk to officer in charge of impounded vehicles about the return of your car.
