petty theft

i was caught and cited out for walking out of a store with a 94.00 bluetooth. i have a court date of 9-4-08 do i just go and plead no contest and pay fine,or what

You should get a lawyer and discuss your options with her. Petty theft may seem like a minor thing, but if it goes on your record it will haunt you forever. Many prospective employers will not consider hiring you, for example. And if you are ever convicted of a similar theft in the future, that charge will be a felony because of your prior conviction. Do not simply accept these substantial consequences without at least discussing your options with counsel.

Depending upon the facts, there may be ways to defend against the charges. Even if the defenses seem unlikely to work, they may give you leverage that will help you get a plea bargain involving a less serious charge. If the store is cooperative, your lawyer may also be able to negotiate a civil compromise with the store which will get the charges reduced or dismissed.

Your lawyer's fee (assuming you can afford to hire one) will be money well spent. If you can't afford counsel and can prove this to the court, a lawyer will be appointed for you at public expense. Either way, you need the advice and assistance of counsel ASAP.

You should have your case evaluated by an attorney. If you cannot afford private counsel, a public defender will be appointed for you.

Do not accept the idea that you simply must plead guilty to whatever the prosecution throws at you. A petty theft charge could have significant negative consequences for your future. If your case cannot be beaten, decent alternative options might exist such as diversion (dismissal in exchange of some classes, etc.) or a plea to an infraction. Getting in touch with a lawyer is a must.
