repeat arrests-no bookings

My friend was implicated by our neighbors as a suspect in a burglery of their home in Feb of 2008. He is on parole and my home was searched turning up nothing. He was questioned initially by telephone on the day that the police searched my home where he rents a room. The detective came to the home one month later to question my friend again. My friend said that he had answered all of the same questions the first time and stopped being cooperative. He was handcuffed and taken to the city jail. He was never booked. He was released. On July 3rd of 2008 he was arrested again and verbally told it was for the burglery and violation of parole. He has been in- carcerated ever since for the parole violation. The city has never withdrawn it's warrant so now he will have to answer to that warrant upon release. I realize a parole violation and a 'new charge' are two different things so to speak. But my lawyer does not feel that the local police have a leg to stand on yet they are pursuing this case anyway. What can we do if anything?

A few handy 'hints' you might get from here are going to do no one any good. Unless he knows how to effectively practice criminal law [which your question makes clear he doesn't], he needs to hire an attorney to do whatever is appropriate to defend against the charges and to bring any motions that might be available. If he can't afford counsel, apply for the Public Defender.
