Legal Question in Criminal Law in California

solicit

On October 1999, I was arrested and cited for solicitation (prostitution), I failed to appear for the Court appearance. On July 2005, I was involved in a vehicle accident and during the course of the incident I was arrested and taken into custody on a warrant for my FTA on the solicitation charge. I was later released on a promise to appear in which I was given another Court date, which I again have failed to appear. Can you please advise me on my options and possible outcomes if I turn mysef in.

I am in fear of losing my job and the embarrassement of my family finding out the orignial arrest. Furthermore I have just found out that my license has been suspended by the DMV. Any help or advice would be grately appreciated.

Your license was suspended for the failure to appear and maybe even for the accident. You can get that cleared up by appearing in court and getting the warrant recalled and quashed. Bring a bail bondsman to that hearing because the judge will set bail if you don't plead guilty or no contest. You should really get a lawyer. Check out my background by looking at my website, and if you don't hire me, you will get some good information, but do yourself a favor get a good lawyer. You might not have to appear in court if you get a lawyer.

I respectfully disagree with attorney Wagner that you won't have to show up in court if you get a lawyer. You broke two promises to appear, and you are going to have to face the music. Arrange to take a few days off from work and go to the courthouse and see the clerk, with a lawyer if you can afford one and have someone in your family with cash, ready to deal with the bondsperson. You didn't say why your license was suspended. Did you have auto insurance? Did you file a form SR-1 with DMV after the accident?

You really need to personally appear in court, to convince the judge you are finally ready to 'deal with' the problems. Have an attorney go with you, as you face serious risk of jail time and substantial fines that he can better negotiate down than you can. The court will recognize that you have taken it seriously by hiring an attorney instead of thinking you can 'waltz' into court and talk your way out of this. You need to arrange funding for the likely fines and bail if you want to stay out of jail. You will be far more embarrassed if you get taken away in handcuffs again from a traffic stop, at which point the court is going to have no sympathy for you regarding bail or fines. Thank you for your posting to LawGuru. Your only option, really, is to turn yourself in. The warrant cannot be recalled unless you, or an attorney, appears before a judge, and as long as the warrant is outstanding, you can and may be arrested at any time, for almost any reason, and that's even more likely now that your license has been taken away.

The possible outcome in your case could be as good as a dismissal, for failure to prosecute within the statute of limitations for solicitation, (if grounds exist), all the way up to the maximum, which is six months, assuming that new charges for failure to appear weren't filed.

Another option is to post the bail set in the arrest warrant, and be booked and released with a new court date, that an attorney can usually appear on your behalf for.

I can tell you that delay doesn't work in your favor. Taking care of this, so that your job and your family doesn't find out at a time you cannot control in the future, is not just the responsible thing to do. It's your best option in this case.
