Legal Question in Criminal Law in California

My son was arrested at Walmart on 8/23/2009. He worked there for a little over a month and is being accused of stealing over $2000 from his drawer. He admits his guilt and wants to pay Walmart back the money he stole. This is his first offense and he has never been in trouble with the law. We go to court on 9/21/09. Is there anything we can do to help prevent him from serving any time in jail? Please help me. My son is a good kid I swear he just made a seriously terrible mistake and believe me he admits it and is ver remorseful.

He potentially faces grand theft - a charge that can be either a felony or a misdemeanor. Of course, the specific facts of the case and how he proceeds from here will determine his outcome. There can (although there is never a guarantee in any case) be ways to keep this from becoming a conviction or to minimize any impact on his future.

I practice in Orange County - let me know if you want to discuss it further.

I would suggest retaining an attorney to help your son with the situation.

Help for him? Of course. Get him an attorney, unless he can effectively represent himself against a prosecutor trying to put him in prison. If serious about getting counsel, feel free to contact me; I've been doing these cases for over 35 years.
