Subpoena

My fiance has a subpeona to testify against his brother, even though he was not present at the event. Is there a law that helps protect my fiance from testifying?

No, but your fiance has the duty to testify only if the subpoena was valid. Subpoena served by mail is not valid in CA unless the person being subpoenaed called back and agreed to the subpoena.
