Legal Question in DUI Law in California

DUI and probabtion....

I am currently on probation for a misdeameanor theft charge back in 2004. I did my community service, paid all the fees and stayed out of trouble. Will a DUI revoke my probabtion and put me in prison??

Not necessarily, but you need to handle the DUI properly and make a good case for minimum penalties and jail time. That is what your attorney is for. Feel free to contact me if you decide you need an attorney.

Well, you really didn't stay out of trouble, you were cited for DUI. Typically, probation terms include that you will 'obey all laws,'' so technically a DUI is a violation of your probation. If the DA or CA wants to, they can violate you. What you need to do is take care of the DUI expeditiously, and when you come up for probation review, have an attorney help you. Good luck.

YOu definitely need to be represented by an attorney in this matter. You may want to include any probation voilation if you enter into a plea bargain for the dui.
