Legal Question in DUI Law in California

I hired an attorney. its been its been over 4 months since ive got my the ticket.. my case manager is telling me that the dmv hasnt recieved the report and that is why the dmv is re scheduling the hearings.. as well as the court. The DMV reschedulled twice. Is it true that it takes the DMV along time to get the case and the blood results?

No. Blood results should be available within two weeks.

Your "case manager" (I assume you hired a large firm where your case is predominantly handled by non-attorneys) should be able to give you a straight answer about why your case is continued for so long. The good news is that the DMV should be extending your temporary license pending the outcome of the hearing so you aren't suspended yet.

Whenever I hear the words,"case manager", it concerns me. In the 20 years we have handled DUI's, it has never taken 4 months. While different jurisdictions vary in some regards, these facts seem very suspect. You should contact the law firm you retained and demand tro speak to a real live attorney and ask some very pointed questions. If you aren't comfortable with the response, assuming you get to speak to an attorney, that's usually a bad sign. Contact a qualified attorney in or near your area to get a second opinion if you are feeling uncomfortable. I wish you well......... David Wallin
