Although the statutory penalties for a second DUI are only 96 hours in jail, in Orange County, they often try for much, much more. How much more depends on:

a) if you're actually convicted

b) your blood alcohol

c) how long ago your prior was

d) can they prove the prior was valid and

e) everything else.

Was there an accident? How did you perform on probation for your first? Did you complete all the requirements? Was your license valid? etc, etc, etc.

I've seen plea offers everywhere from striking the prior and treating this case as another first without jail time to house arrest, etc. It all depends on the particulars.

The same as any other county: whatever your attorney can negotiate in a plea bargain, using whatever facts, evidence, testimony, defenses, etc that may be available and be grounds for motions or defense at trial. If you go to trial and lose, you face jail and other penalties enhanced for second offense if within ten years of first conviction.
