Legal Question in Elder Law in California
Conservatorship
I would like to sell my 96 year-old Aunt's home and use the proceeds to put her in a retirement home/assisted living facility.
She is unable to care for herself and requires 24 hour care. She is unwilling to sell her home and believes she can care for herself.
She does not have any children. I am her great niece and one of her closest living relatives.
What legal action do I need to take to gain control of her assets and medical decisions?

Re: Conservatorship
You must obtain a conservatorship and get the required sale orders by filing the appropriate set of pleadings and supporting documents in the courts of the county where she resides. This is a document and proceedure intensive process, usually handled by experienced counsel. The conservator is entitled to have the estate pay the attorneys fees as well as the conservator fees.
