Legal Question in Entertainment Law in California

Hello, I have a friend who made a verbal agreement with a director for a small budget music video. The director agreed to the flat fee up front in return for his services. Upon shooting the film equipment was stolen and he is now refusing to turn over the video until the band pays for half of the stolen equipment, he believes they are liable because it was there production and he was a hired hand however there was no written confirmation that this is the situation.How can they get there film?
