Legal Question in Entertainment Law in California

personal rights

A movie was made about an occurrence in which I was a participant. The movie states: Based on a True Story. There is a character who is based on me (I was married to one of the main characters) I was never consulted regarding use of my character or my life in this film. Do I have rights?

Re: personal rights

You might. In the right circumstances, it is possible the movie makers illegally misappropriated your life history, your likeness, or other protectible elements of your life experiences. Often these kinds of disputes can be quickly settled to avoid the possibility of negative publicity. The risk of publicity is a card that can be carefully played to your advantage as negotiating leverage. "Careful" is the key word here, however.

I just handled a high profile case somewhat similar to this, with very intense publicity consequences which significantly impacted the result. Feel free to contact me directly for a free initial office consultation concerning this matter.
