Legal Question in Family Law in California

changing a child's last name

My daughter has her father's last name (my ex-boyfriend) but he is not listed on her birth certificate. Can i change her last name to my husband's last name? And can he legally adopt her? My husband supports her totally and my ex-boyfriend is not around. Also, i have sole legal and physical custody of her and am not getting child support. Please let ne know what i can do. Thank you.

Your husband can try to adopt your daughter. You will have to give your daughter's father notice.
