Child Custody

We have had my step son for 6 months, his mother resides in NY. She gave us permission to take him out of state. She is now under investigation for SSI fraud, benefits she was receiving on the childs behalf. SSI contacted us as they have been unable to locate her. Her phone number is disconnected and we have no way to reach her. Can we file a child custody order in CA at least on an emergancy basis to protect ourselves, or will it have to be done in NY?

I am not sure what you want to file, however, any court actions should petitioned in the court where the custody matter was heard and adjudicated. You may petition that court for removal to a venue more convenient if that is what you require. Good luck-Martin
