child custody and support

My boyfriends ex-wife had custody of their 3 children. She put them in danger and was arrested so now they are with us. We will be in court soon to modify the custody order. In the meantime, because the child support is so high, we can barely afford to pay our rent. Child services says we have to prove that we have custody of the kids. Is there a way to get the child support order overturned quickly so that we can provide for the kids? I don't want to lose everything while we are waiting for court dates.

You should file a motion to modify child support. Request an order shortening time to serve the motion and for the hearing. State in the supporting declaration that you are in desperate need of modifying the support to have the money to provide the necessities for the children. Also attach a copy of an certified order from the juvenile court giving you custody.
