Legal Question in Family Law in California

Children choosing which parent to live with

My daughter is 12 years old and her mother is planning on moving to another state. Her mother has physical custody and we share legal custoday. My daughter does not want to go and wants to stay here with me. Is she of age that she can now choose which parent she lives with? I heard somewhere there is an age at which this is possible but I want to verify this.

Re: Children choosing which parent to live with

In a general sense, it has to do with the maturity level of your child. 14 is a significant age but your child at 12 may be more mature than many 14 year olds. Move away cases are treated differently and bring about more issues to consider.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
