Child custody and Welfare confusion

I live with my kids father with no other place to go, I am on cash-aid and my kids father will not let me take my child. What are my options on gaining custody of my child and how my being on cash-aid while living with the father will effect my well-being. I recieve cash from the state but they are under the impression I am not living with the father. Since I am, is it me commiting fraud? It has only been 3 months, what are the penalties? Can I lose my child over this? Please help me with some advice. The father will not comprimise and hold my kid hostage. What do I do, I can't take my kid anywhere outside his house. How is he committing a crime? Thank You

You are committing a crime, fraud and perjury by living with the father and not reporting it to welfare. You should contact a local domestic violence help organization. Even if there is no physical abuse he is abusing you emotionally and holding you hostage. Report that the father of your child is living with you or take immediate action to move out of the residence.
