Legal Question in Family Law in California

Credit from child support for college expenses

What would a reasonable percentage be to deduct from child support payments when the child still lives with the custodial parent 4.5 months out of the year? The support covers two children, only one of which will be going to school. One half of the tuition for the year exceeds one half of the total child support for the entire year.

Thank you.

Re: Credit from child support for college expenses

In California child support is determined by a computer program. This program uses the gross income of each parent and the per cent of time the child is with each parent. 4.5 months of visitation would be about 37.5% which would translate into a much lower child support level.
