Legal Question in Family Law in California

divorce

i would like to file a divorce. Our married was held in the Philippines. He is residing in the philippines. Can i file a divorce here in CA? We have mutual understanding with regards to how to handle our five kids. No settlement with the property and just a basic divorce. Please give me an info. If just in case this divorce is not permitted in California, can i file in Nevada? Thanks.

You can file for divorce in California if you have been a resident of the State for 6 months, and the County for 3 months.

If you've been living in CA for the last 6 months, you can file in the county in which you've been living the last 3 months. You can get orders regarding becoming single (change of marital status) and maybe custody issues, but not property division or support, unless your husband had sufficient contacts with this state.
