divorce-moving out of state

daughter wants to move,(from california to kansas) start new life, (home and job waiting) living with mother-in-law. ex-husband lives out of state (south carolina) why can't divorce papers (30 days filing) be mailed to her also (mailed to him) and why does she need to wait and petition court? (another 30 to 60 days) with possible loss of sole custody of 3 children.
