Legal Question in Family Law in California

Eviction of adult child from home

my wife and I have fully supported our 25 year old daughter from age 5 (our second marriage). she was married for approximately 6 months and lived with her husband unitl their divorce at which time she moved back home and has been in our home with split custody of her child since that time (7 years). She has not held any of her 3 jobs longer than 6 months during which she does not contribute to the household in any manner, including rent, food or household choirs. She continually steals money and goods from us and we are forced to lock our valuables away when we are not present in the house. We have considered adopting our grandson, but she refuses to discuss this issue (knowing the grandson is her meal ticket). She has a drug dependency and has demonstrated violent behavior toward her biological mother and I.

My question is this: what are my legal obligations to formally evict her from our house and are there justifications maintain custody of our grandson?

Re: Eviction of adult child from home

You could file a petition for guardianship of your grandson. You should try to get a temporary guardianship order before she is aware of the petition for guardianship. Once she is aware of your petition she is likely to take off with the child. If all else fails then you can call CPS.
