Legal Question in Family Law in California

parent without custody of children seeks divorce

I have three children that are out of my custody. They are in custody of their grandmother, whom has been their legal guardian for some time. My wife is currently in state prison, and also is not their legal guardian. My question is how do i start divorce proccedings and how will it relate to the children if at all?

As part of the dissolution you complete a form that tells the court that another court has taken jurisdiction over the custody of the children. Otherwise you would proceed as a normal dissolution, without the court have jurisdiction over custody of the children. Good Luck, Pat McCrary
