Legal Question in Family Law in California

My husband was married to his first wife for 7 yrs. He has been paying support of 350.00 a month for 30 yrs. It is deducted from his pay check . The ex-wife is in a group home because she is mental, she became mental during the marriage .My husband is now retiring and his income will change. Shoukd he still be paying this ? thank you ...Y.B.

He should consult with an attorney regarding his spousal support payment. Thirty years ago it is probable that the spousal support order was for life. He should also investigate SSI for her. It appears that she is disabled. As such she should qualify for disability income or social security income. This would give her some income and potentially reduce his spousal support. He should not file a motion to reduce spousal support until he has reviewed the matter with an attorney.
