joint custody w/ out of state father

My daughter is 7yrs old and I am the custodial parent. Her father and I have never been married or have we ever lived together. He has never been responsible for her day to day needs w school or activities. I've never denied him acess to visitation or any type of communication. He has contributed to our daughters educational needs and has given financial support as he saw necessary. Last year, he relocated to Dallas, Tx and got married. Several months prior he had a son by a women other than the women he married. Now he is sueing me for joint physical custody. How likely is he to get it? and what can I do to assure that visitation remains in California? He is still employed here in the Bay Area and travels back and forth a least twice a month. I do not oppose any type of standard visitation. I believe that my daughter deserves to have a relationship with her father and I would never want to come between them. What are my chances? I just want what's best for my daughter. The amount of contact with her father has been minimal over the past several. Her contact with her father has been minimal and not consistant. There is no need for dramatic change that will be disturbing in our daughter's life.

I agree with Mr. Fernandez. You have all the facts on your side but you must have a lawyer to argue your case effectively. It is too bad but it is true. You simply cannot do this by yourself. Like Mr. Fernandez said, you must get an attorney "Cut and dried."

You need to retain a lawyer cut and dry. Unfortunately my firm does not handle family law cases in the bay area.
