Legal Question in Family Law in California

Marriage License Legal in Jamaica

Hello,

My husband and I were married in Feb 2001 in Ocho Rios Jamaica. We have not filed for a marriage license in California, because until recently, a friend said our marriage may not be legal because we were married in Jamaica. I am trying to find out if our marriage is legal or do I need to get married again here in the US? Thnak you for your time.

Re: Marriage License Legal in Jamaica

If you marriage is valid in Jamaica it should be legal in Cal. A copy of the Cal. law is copied below.

FAM 308. Out of State Marriages

A marriage contracted outside this state that would be valid by the laws of the jurisdiction in which the marriage was contracted is valid in this state. [Added 1992 ch. 162 (optve. January 1, 1994).]
