Legal Question in Family Law in California

Married, did not live under same roof full time

Just prior to our marriage my husband retired and purchased a home in Southern California. We were living together in another of his homes at the time. We had a falling out and he moved to Southern California and I signed a one year lease on a duplex here in Northern California. Very shortly after we worked things out and got married. I wanted to honor my lease, so we decided that I would work part-time and travel back and forth between residences (his home in So Cal. and my rented duplex in No. Cal.) with the understanding that I would move full time to southern california when my lease was up (approx. 8 months later). During this time my husband supplemented my income. Unfortunately, we are now headed toward dissolution. My question is, am I entitled to any kind of settlement upon dissolution of marriage? I understand that I wouldn't be entitled to any portion of the home my husband purchased before marriage, but rather am I entitled to any other form of settlement. We will be married a year in September 2005. I welcome any clarification you can give me. Thank you.

You did not provide enough facts for me to render an opinion. You may be entitled to Spousal Support, the community may be entitled to a pro rata interest or credit in the home he purchased if community income went into paying a mortgage or improvements. Too many issues, not enough facts. I would be willing to dicuss the case with you. You may call me at 818-739-1544 ext.15
