moving out of state or country?

Hi, my divorce is for abusif verbaly and i want to move either from californie to New Jersey or California to where i'm from originaly in Montreal Canada, we still not done with the papers of divorce ,I did file in july 07, so now what's the law about that and what can I do to help to win it,, by the way my ex.. just lost is job and i work but doesnt make enough to support the rent and all. thanks

You do not mention any children. Assuming that there are no children involved, you are free to move to Canada at any time. When children are involved, the court can only order that the children are not removed from the state. You can file for divorce in Canada after meeting the residency requirements for a divorce.
