Legal Question in Family Law in California

I have been in a nasty custody battle with my ex Husband for years now. Our Daughter turned four in April and it's that time to consider pre schools. I am now remarried and relocated to a city an hour away. The schools out here are rated just the same as where he is living. Low. I have two step daughters grade Kindergarten and Second, they both go to a private school out here with AMAZING curriculum and a great foundation. My step children are very bright. My ex husband is refusing. Wants her to go to school where he lives which means our 60 (me) and his 40 (him) will change dramatically. He is a fire fighter so he has a 24 hours on and 24 hours off schedule, so our custody schedule changes and is very specific. (People don't know how we manage). My question is what are the chances a judge will take her from my home and put her with him. If that does happen my percentage will go down 20 or lower. I know it may sound like I'm just worried about not having her no, i have taken care of our daughter her entire life and he dad has been absent a lot. I plan on filing through courts about this issues because there are so many things to consider. Thank you.
