Legal Question in Family Law in California

rescinding a child custody mediation agreement

My boyfriend has tempoary physical custody of our 10 month old son. We have gone to mediation and when I got a copy of the mediation agreement I was unaware that the changes I had requested went against me. I had asked for joint physical custody and thought that is what we agreed upon. I either misunderstood or was mis let about the temporary custody being still in effect. How do I rescind the latest child custody mediation agreement? If there a form? What is the procedure?

Re: rescinding a child custody mediation agreement

If the mediation agreement as already been made an order of the court, then you need to file a motion to set aside the order. If it hasn't, then tell the judge before s/he adopts the agreement as an order of the court.

In a general sense, you can object in writing within 10 days which vacates the mediation agreement.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
