Retirement award in Divorce
20 years ago when I got my divorce I was awarded a portion of my ex husband retirement based on months married. It was a difficult divorce so my attorney was suppose to attach this so I would receive the payments from the company directly. He did not do this. My question is do I have to go back to court personally to get this done? My ex husband has had no contact with his children for years and they are now grown and I do not want to have to fight him on this. Could he have this taken away from me in court?

You do need to serve papers on the retirement plan. This should have been done long ago. Perhaps your attorney at least joined the plan?

What you serve depends upon what kind of retirement it is. Military, private, governmental, defined benefit or defined contribution.

This is an area of law rather complicated for a lay person. You need to hire counsel.
