My Son's Ashes

My Son was killed in a job accident in 1986. My EX husband & I agreeded to have Mike Cremated. Ex Husband picked up the ashes of my son and has never let me have them. Nor asked me when we would scatter them, He has just stolen them from me. ...Recently I asked again for my son's ashes. He has said no and he will be buried with them... I can't let that happan. My son was raised by me. Ex had nothing to do with Mike. He never went to a little legue game nor High School football game to watch his son play. Never took part in any activity with my son even tho he was asked many times. What do I do? It's been over 19 years now. Should I go to small claims court? Please help me. Ex is 72 years old now and I am 66. This needs to be resolved.
