Legal Question in Family Law in California

My spouse has accumulated $6K of credit cards debt during the two years of marriage, $2K of which was used to buy furniture for where we live. I am resposible for 50% of this debt when we file for a divorce?

Yup, although if she bought a lot of personal stuff with it, you can ask the court to saddle her with the share of the debt attributable to the personal effects she will take from the divorce.

I agree with Mr. McCormick. California is a community property state and the general presumption is that all assets and debts acquired during marriage are considered to be community property except for that which was acquired by gift, bequest or devise. Basically this means you equally share the assets and debts you acquire during the marriage. You can argue about personal items and in that respect I also agree with Mr. McCormick.

Good luck
