Visitation Rights and Responsibilities

Non-custodial parent has made arrangements to pick up child from custodial parent's house for one week, court imposed visistaion, but refuses to provide custodial parent with a home address accross the state. Custodial parent feels that non-custodial parent may not return child, as he is refusing this information. WHat are my rights as the custodial parent, and what can happen if I refuse to allow the visitation on these grounds? Please answer as soon as possible time is of the essence.

Mr. Koury is correct. If you do not obey the court order you can be found in contempt.

If the non custodial parent does not return the child after the visitation, contact the local district attorney. The district attorney will attempt to get the child returned to you. If that fails then the district attorney will obtain a warrant for the arrest of the non custodial parent. It may take a long time to locate the non custodial parent and have him arrested.

You should immediately contact an attorney regarding the up coming visitation. although the time is late the attorney may be able to help you by getting the address. You may be able to get an ex parte order that the non custodial parent to give you the address to which the child will be at during the visit. Do not waste any time act immediately

If you do not allow the visit you can be jailed for not obaying the court order.
