Does my wife's ex have any rights to her daughter if he is not the biological father ,but his name is on the birth certificate,and is it illegal for him to do a paternity test without her knowing?

That many depend upon whether he signed a declaration of paternity. It can also depend upon many other factors such as the age of the child and his history of contract with the child..
