Legal Question in Family Law in California

I am currently working in a private company that is not yet public. I would like to know can my spouse get half of my incentive stocks when we file for a divorce?

It is never possible to be sure what the property division will be in a divorce without knowing all the financial facts of the family. However, assuming you took this job during the marriage, any incentive stock earned during the marriage will almost certainly be community property to be shared in a divorce. Valuing it may be tricky unless the company goes public before you separate, but it almost certainly will be included in the community property.
