Legal Question in Medical Leave in California

Doctor's note upon return from intermittent FMLA

If I have approved intermittent FMLA and I phone in that I am exercising my right to use an FMLA day, can my employer ask for a doctor's note upon my return?

Yes. Any time you take FMLA time off you can be asked to provide medical proof. I encourage you to look to your employers handbook and/or polices and procedures to assist you in this process. Should the employer be abusing the process or demanding verification from you and only you, then I suggest you seek legal advice.

Best of luck.
