Legal Question in Medical Leave in California

Can I get fired by using the Family Medical Leave act? My husband has to have surgery in the next few days and the Dr has just finished the paper work for me. my company is already giving me a hard time.

The purpose of the Act is to prevent firings. You need to figure out the benefits offered under the Act at your company (assuming it has the obligation to provide these benefits) and make sure you take all the compliance steps you need to do before leaving for time off.

As long as you meet all of the eligibility criteria, your employer cannot lawfully fire you for taking fmla leave. Work with your HR representative to make sure you've completed all the necessary forms. Also ask to see the posting all employers are required to have hanging in a conspicuous place, advising employees of their rights to take family care leave.
