Legal Question in Medical Leave in California

Leave Law for Small Businesses

What is the leave law for a small business, with 40 employees? I'm trying to understand our requirements in terms of leave length of time and paying benefits for pregnancy leave, as well as disability and family leave.

Re: Leave Law for Small Businesses

Only companies with 50 or more employees are subject to family leave laws, but all California employers that have 5 or more employees must grant maternity leave for up to 4 months if medically necessary. Medical leave and disability laws are complex and often overlap and cannot be adequately explained in a short e-mail. You need to establish a relationship with a labor law attorney to explain the intracacies of leave laws to avoid getting yourself into trouble. Check with your local bar association for references.
