Legal Question in Medical Leave in California

Do I quilify for Clifornia Family Leave Act?

I have been employed by my company for 12 1/2 months now. I went on maternity leave I had a complete placenta previa (high risk pregnancy). My company says I do not quilify to take any more time off because I took time out before I completed a year with the company.

I worked 9 months straight, over 1,250 hours then took 4 weeks before delivery (doctors oders due to my condition) Had a very difficult labor. Baby suffered Brachial Plexus injury. Stayed out on maternity leave 9 weeks after baby was born(doctors orders again). I'm still overwhelmed I need more time off. I am not ready to go back to work yet. I don't think I could function properly at this point.

I don't want to loose my job. Please help me out

Thank You

Re: Do I quilify for Clifornia Family Leave Act?

You qualify for 12 weeks leave during a year. Since you've taken at least 12 weeks already, the company may refuse to grant you more time under FMLA.

Further information is required to make a definitive response, but it appears you have exhausted your FMLA leave.
