Legal Question in Civil Litigation in California

account number theft

First I am not sure the area of law above is correct. That is part of my question. I had an individual use my checking account number to buy porn on the internet. The police tracked him down and he admitted it. The police said I should file a civil suit against that individual? So does that mean I just go to the court house and file civil suit papers? If so what happens next? Thanks for your time.--name removed--

Re: account number theft

Well, if you know what papers to file, how to properly draft and prepare them, and how to then conduct and pursue all the litigation discovery proceedures, motions, hearings and trial, sure, you can do that. Otherwise, contact an attorney who is experienced in litigation to see if you have a case, and whether it is worth pursuing. What makes you think the defendant has any money or assets to pay a settlement or judgment, or to collect against after you spend all the time, fees and costs required in a lawsuit. If you do have a defendant with assets, then feel free to contact me to see if it makes sense to have an attorney pursue the case.
