Legal Question in Civil Litigation in California

Auto Dealership taking advantage of the Elderly

My mother has bought 2 cars at the same time. She has been taken to small claims court. She was unable to attend the court date because she is in the hospital. I wrote a letter to the judge requesting another court date but they made a judgement against her. She is still in the hospital and can't do any of the paperwork. She is on a fixed income and can't pay the money requested by the judge but she has proof that the company broke a good faith contract. Please I need help for her and the deadly is coming down to the end for her to file, she has the 4 contracts they wrote. She has all the paperwork.

thanks

Your mother should file an appeal. She will be afforded a trial de novo, that is a completely new hearing before the Appellate Department of the Superior Court. Check out California Code of Civil Procedure Section 116.110 et seq.

from the facts given, your mother can appeal the judgment against her. if she would like legal assistance in such a preparation, feel free to email me directly.
