Legal Question in Civil Litigation in California

concern about my lawyer

my lawyer said that the discovery questions and answers were due may 5th, so I submitted my responses to him. However he has not communicated to me since then. I called him several times but he never returned my call up to now. Is this a normal process? Should I be concern? my case is disability and breach of contact. I am the plaintiff.

Your attorney might be busy or in trial or even out of town. A whole month without a phone call returned is a long time however. You should address this with him when you do talk to him to make him aware that like anyone else, you expect to hear from him promptly (within a day or two).

It is not clear exactly what kind of case the lawyer is handling for you. If this is a personal injury case and you were required to answer interrogatories, your responses should have been put on pleading paper and you should have had to sign a verification swearing the answers were true. If this is some other kind of disability case, I do not know what the procedure might be to submit answers to discovery.

In either case, where your lawyer has not returned your calls, you have a right to be concerned, especially if there is litigation in progress and there are filing deadlines to be met. If it has been a month since you first called, you might consider filing a complaint with the State Bar of California.
