Legal Question in Civil Litigation in California

Dr. fills out paperwork with completely wrong info.

I am writing to ask who or if I even should talk to someone about paperwork being filled out improperly by a physcian.

I was told I could not return to my job due to an injury, and when I presented the same dr. with medical retirement papers he filled them out stating that I was NOT incapacitated to the point of not returning to work, AND he incorrectly marked boxes saying that I was not mentally capable of entering into binding contracts, or signing checks!

I have never had any type of mental disability,nor did I choose to retire, I was given no other option after this dr. said I could not return to my duties.

This dr. has already mailed these incorrect papers to our retirement services department, and now I am afraid that not only will this prolong the process, they will think I am committing some type of fraud when I send in the corrected papers.

Doesn't the dr. have some liability to be sure the paperwork he fills out is based on the proper information for the proper patient?

This could effect my entire future, please tell me where this falls and if I have some type of recourse.

If this is a worker's comp doctor, which I suspect it is, you should seek a worker's comp attorney to assist you.
