Legal Question in Civil Litigation in California

Where do I file my claim?

I purchased something on line at an auction and sent a money order. Supposidly the money order never got to the person so I figured it got lost and I made a payment to the person by my credit card. I filed a claim with the P.O. on the M.O. and told them it was lost, if it comes back that it WAS cashed, and I go to sue the person for the $ back, do I file in my city, or their city?

Re: Where do I file my claim?

I will need more facts...your location, the seller's location, the nature of the sale.

Try and get a refund from your credit card company. Explain the situation and you may get lucky..... and be more aware next time when dealing online. Thanks for your question and good luck.

contact the police and DA in the city where he is, and contact the Post Office inspector's office. Get them to pursue collection or prosecution for fraud. Contact your credit card company to reverse the charges because of the double payment.
