Legal Question in Civil Litigation in California

Must All Plaintiffs be Listed on Lawsuit?

My brother, the defendant, reached an arbitration agreement and just found out after one year that the agency he was formerly contracted with is collecting his monthly payments even though they were never listed as a plaintiff. They used the name of a huge insurance company he formerly sold products for. This insurance company is one of its carriers. Can they do that? He was always under the impression that the insurance company was suing him because they originally contacted him. Thank you.

Can they? Aren't they already doing so? The proper question is what to do about it now. Feel free to have him contact me to discuss the actual facts, not generalizations, to get an informed opinion about his rights and remedies.
