tree and fence

A part of my tree trunk touches at

the top of my neighbor's fence which

is ten fee high. He claims my tree is

destroying his fence- I think his fence

is too high.If his fence were six feet

there would be no contact between

my tree and his fence

I think you both should just agree to trim the tree,it is a lot cheaper and better than a law suit with your neighbor. But, his fence being too high is not an excuse for your tree being to long. If you complain to the city, they may make him remove his fence, but they would tell you to trim your tree as well. Good luck.
