Legal Question in Civil Litigation in California

Is Verbal Agreement valid?

I received $19,873. from a settlement but had no way to cash the check. My boyfriend agreed to deposit check into his acct and when check cleared we would open an acct together. He was also helping me with getting my finances on track and to not give any to my sister. Looking back, I should have found another alternitive. Nevertheless, I was supposed to buy a new car but due to credit problems was unable to do that either. He said we could fix up my old car-Never happened. Since then, he said he put my money into a CD for 1yr. I am currently on disibility and need my money to pay my bills. He just tells me he is unable to get it & that I am in no position to demand anything from him. I was stupid & trusted him. What can I do now to get all of my money back?

Re: Is Verbal Agreement valid?

You can sue your boyfriend for breach of contract and fraud. That will cost money though. You could have initially cashed the check by opening an account on it. In either case, your boyfriend is a jerk and the only way to get your money is to sue him, or tell him he has to close the CD and pay the penalty for early withdrawal. If he told you he could not get the money out, he's also a liar. Good luck.
