Legal Question in Civil Litigation in California

Will pay for guidance on collecting on a judgement

A judgement has been filed on my behalf on July 28, 2003 for a little over $10,000.

I would like guidance as to how to collect on this judgement. I would like to do a business assets seizure. I am looking for someone who can inform me of the necessary steps and what to look out for. For example, how to find out if those assests are protected. And what else to look out for before I proceed.

I will gladly compensate you for your time.

Thank you

Re: Will pay for guidance on collecting on a judgement

Check with the California Secretary of State. Liens on business are filed there. You would be checking UCC, Uniform Commerical Code law. A lien is recorded by filing a UUC1 form. Check with the secretary of state's office for the forms and cost of each item.

Re: Will pay for guidance on collecting on a judgement

You should do the following:

(1) file an abstract of judgment and record it in each county where the debtor has real property;

(2) obtain a writ of execution and levy on the business; and

(3) notice a debtor's exam, and , if possible, get a turnover order.

We would be happy to help.
